Brahm Smythe

California DMV Hearing Specialist & Knowledge Expert

I have spent years mastering and analyzing the complex administrative proceedings inside the California Department of Motor Vehicles Driver Safety Branch. Having extensively analyzed formal recorded hearings, sworn driver testimony, departmental exhibits, and official written decisions (Forms DS 2227, DS 2227R, and DSPMR), I understand exactly how decisions are made regarding whether drivers keep or lose their licenses.

Throughout this work, I have analyzed every category of administrative action: Physical & Mental (P&M) medical re-examinations under VC § 13953, Negligent Operator (NOTS) point suspensions under VC § 12810, and high-speed 100+ MPH (FAST) hearings under VC § 22348(b). The difference between a license saved (a Set Aside or Reinstatement) and an outright suspension almost never comes down to guilt or bad intentions. It comes down to preparation.

Most California drivers walk into a Driver Safety hearing room terrified, completely blind to the administrative rules, and unaware of what the Hearing Officer is legally evaluating under the California Supreme Court's Topanga standard. Meanwhile, hiring an administrative attorney often costs between $2,500 and $5,000 — far out of reach for a working family or retiree.

I founded DMVCoachCA to bridge that gap: providing every California driver with direct access to insider procedural knowledge, document checklists, and 1-on-1 strategy coaching at an accessible, transparent price.

The 4 pillars of hearing preparation

How we prepare self-represented drivers to walk into their California Driver Safety hearing with poise, credibility, and evidentiary strength:

1. Complete Department Record Audit

Every hearing officer begins by reviewing your unredacted H6 Driving Record Printout, police collision narratives, and Confidential Morbidity Reports (CMRs). We review these documents in advance to eliminate blind spots and ensure no surprise department exhibits catch you off guard.

2. Medical Evidence Precision (Form DS 326)

For medical cases, Form DS 326 is make-or-break. We ensure your treating specialist checks the correct clearance boxes (specifically Section 6), verifies the required 3-to-6 month control window under 13 CCR § 110.01, and certifies the absence of disabling pharmaceutical side effects.

3. Sworn Testimony & Question Preparation

At a recorded hearing, you testify under oath. We role-play the exact questions the Hearing Officer will ask regarding episode history, warning signs (auras), medication compliance, and daily driving requirements — coaching you to deliver clear, truthful, and concise answers.

4. Strategic Licensing Alternatives

If full unrestricted reinstatement is not immediately granted, we prepare fallback petitions: requesting Medical Probation (VC § 13953) or an Area Driving Performance Evaluation (ADPE) for a restricted license that preserves your neighborhood independence.

What We Are & What We Are Not

DMVCoachCA, LLC is an educational consulting and self-help coaching platform. We are not a law firm. We do not provide legal advice or legal representation, and Brahm Smythe is not a licensed attorney. No attorney-client relationship is formed by accessing this website or participating in any coaching session.

Our mission is to help self-represented drivers understand California administrative hearing procedures, organize their evidentiary records, and prepare their own testimony. If your case involves pending criminal court charges (such as a misdemeanor or felony DUI trial in Superior Court), we strongly urge you to retain a licensed attorney.

Looking for legal representation instead?

If you prefer an attorney to appear on the record on your behalf rather than representing yourself with our coaching, we recommend searching the State Bar of California's certified attorney directory at calbar.ca.gov for licensed attorneys specializing in California administrative hearings and DMV defense in your county.
