California NOTS Point Suspensions: How to Protect Your License

California DMV Knowledge Expert insights into the Negligent Operator Treatment System. Learn how points are calculated, how to secure an immediate Stay of Suspension, and how to keep driving legally for work.

The 14-Day Clock & The "Stay of Suspension"

When you receive an Order of Probation & Suspension (Level 3), the countdown begins immediately under California Vehicle Code § 14100.

⚠️ 14 Days (Mailed) / 10 Days (In-Person)

Demand Your Hearing Immediately

California Vehicle Code § 14100 & § 14250
  • The Rule: You have 14 calendar days from the date stamped on the notice (or 10 days if hand-delivered) to request an administrative hearing.
  • The Stay of Suspension: When requesting your hearing, you must specifically demand a Stay of Suspension. A Stay legally freezes your suspension date, keeping your license 100% active while you prepare.
  • The Risk: If you miss the deadline by even 24 hours, the DMV computer automatically revokes your hearing right and suspends your license on the effective date.

What the Hearing Officer Decides

California Vehicle Code § 12810.5 & § 13800
  • Not a Traffic Court Trial: The Hearing Officer does not re-litigate whether you were speeding or ran a red light. The traffic court conviction is conclusive.
  • Evidentiary Burden: The Hearing Officer determines whether you are statistically a "negligent operator" posing a hazard to public highway safety.
  • Mitigation Matters: By introducing mileage records, employer hardship, and proof of rehabilitation, you give the Hearing Officer the legal authority to set aside the suspension.

How California DMV calculates NOTS points

Under California Vehicle Code § 12810, traffic convictions and accidents add points to your DMV H6 record:

Standard Drivers (Class C)

California Vehicle Code § 12810.5(a)
  • 4 points in any 12-month period
  • 6 points in any 24-month period
  • 8 points in any 36-month period
  • Point values: Standard moving violations (speeding, lane violations, stop signs) = 1 point. Serious offenses (DUI, reckless driving, hit-and-run, driving on suspended license) = 2 points.

Commercial Drivers (Class A / B)

California Vehicle Code § 12810.5(b) — The 1.5x Multiplier
  • 1.5x Weighting: Any violation committed in a commercial motor vehicle is multiplied by 1.5 on your record (e.g. 1 point becomes 1.5; 2 points becomes 3).
  • Higher Thresholds: To compensate, commercial drivers have higher allowances: 6 points in 12 mo, 8 points in 24 mo, or 10 points in 36 mo.
  • Livelihood Protection: A NOTS suspension immediately disqualifies a commercial endorsement. Quick hearing action is critical.

The 4 levels of the NOTS system

The DMV's Negligent Operator Treatment System is designed as a four-stage progressive disciplinary ladder:

Level 1 (K01)

Warning Letter

Triggered at 2 points in 12 months (or 3 points for commercial). A computerized advisory letter notifying you of your point accumulation. No hearing rights apply.

Level 2 (K02)

Notice of Intent to Suspend

Triggered at 3 points in 12 months (or 5 points for commercial). A final warning that one more conviction will result in an immediate suspension. Take immediate steps to avoid moving citations.

Level 3 (K03) • Critical

Order of Probation & Suspension

Triggered upon reaching the statutory threshold (4, 6, or 8 points). DMV orders a 6-month license suspension and 1-year probation under VC § 14250. You have 14 days to request a hearing and a Stay.

Level 4 (K04)

Violation of Probation / Severe Collision

Triggered if you receive a new moving violation or at-fault collision during your 1-year probation, or are involved in a fatal or serious injury collision under VC § 13800. Results in an immediate suspension.

The 5 evidentiary defenses Hearing Officers accept

How Hearing Officers evaluate mitigating evidence to reduce your point total or waive your suspension:

Evidentiary Defenses for NOTS Administrative Hearings
  • ✓ 1. High-Mileage Defense (VC § 12810.5(a)): If you drive significantly more miles than the average California driver (typically 25,000+ miles/year for outside sales, rideshare, delivery, or commercial transport), California law recognizes that your statistical exposure to citations is higher. Presenting proof of high mileage gives the Hearing Officer discretion to treat you under higher point guidelines.
  • ✓ 2. Disputing "At-Fault" Accident Points: DMV often enters a 1-point penalty for collisions based solely on the financial accident report (Form SR-1). At your hearing, we review the actual police Traffic Collision Report (CHP 555). If the report shows you were not the Primary Collision Factor (PCF) or no citation was issued, the Hearing Officer can strike that point from your NOTS count.
  • ✓ 3. Court Abstract & Traffic School Discrepancies: Court clerks frequently make clerical errors when transmitting conviction abstracts to the DMV. If you completed traffic school for an eligible citation, or if a citation was dismissed or reduced in court but still appears as a point on your H6 record, correcting the record can immediately drop you below the 4-point threshold.
  • ✓ 4. Hardship & Course-of-Employment Restricted License: If the Hearing Officer sustains your point count, they have the statutory authority under Vehicle Code § 12812 and § 12813 to issue a Course-of-Employment Restricted License. This allows you to drive during work hours and between home and your workplace with zero days of complete suspension.
  • ✓ 5. Proof of Rehabilitation & Driver Improvement: Proactively completing an approved 8-hour traffic safety or defensive driving course prior to your hearing demonstrates remorse, safety awareness, and active rehabilitation. Hearing Officers routinely use this to justify an Order of Probation in lieu of suspension.

The 3 official NOTS hearing outcomes

Following your testimony and exhibit review, the Hearing Officer will issue an official written decision:

1. Set Aside (Action 23)

Complete dismissal. The Hearing Officer removes an erroneous point (e.g. an improperly attributed accident) or grants a high-mileage exemption. The suspension is set aside entirely, leaving you with full, unencumbered driving privileges.

2. Probation with No Suspension (Action 13)

Most common victory. The 6-month suspension is completely waived. You are placed on 1-year probation. As long as you receive no new moving violations or at-fault collisions for 12 months, you drive without interruption.

3. Sustain Suspension (Action 19)

Suspension upheld. Imposed if the driver fails to appear, presents no mitigating evidence, or demonstrates an active disregard for traffic laws. Can sometimes be mitigated to a 30-day suspension with employment restrictions.
